Terms of Service

Welcome to Polaris Car Care. These Terms of Service ("Terms") govern your use of www.polariscarcare.com (the "Site") and any purchase you make through it. By using the Site or placing an order you agree to these Terms and to our Privacy Policy (www.polariscarcare.com/pages/privacy-policy). If you do not agree, please do not use the Site.

1. Who we are

"Polaris Car Care", "we", "us" and "our" mean Polaris Car Care LLC, doing business as Polaris Car Care, Chicago, IL, United States. The Site is hosted by Shopify. Your purchases are made directly with Polaris Car Care, not with Shopify.

2. Using the Site

You must be at least the age of majority in your state to place an order. You agree to give accurate, complete and current information when you order or create an account, and to keep your login details secure.

3. Products and descriptions

We work hard to describe and photograph our products accurately. Colours and finishes may look different on your screen. We may change product details, limit quantities, or discontinue a product at any time.

4. Product use and safety

Follow the directions and warnings on each product label. Keep chemical products away from children and pets, store them sealed and upright, and never mix them with other products. A Safety Data Sheet (SDS) is available on each chemical product page and on request from support@polariscarcare.com. Plate covers are decorative accessories: you are responsible for complying with the plate-display laws where you drive, and the disclaimer on the product page applies. Purchases through our Pro Detailer program are also subject to the program terms at www.polariscarcare.com/pages/wholesale.

5. Orders and payment

Placing an order is an offer to buy. We may accept or decline any order, including for suspected fraud, pricing errors or stock problems; if we decline an order you have paid for, we refund it in full. Prices are in US dollars and exclude sales tax, which is added at checkout where applicable. Payment is taken through Shopify's checkout (cards, Shop Pay, PayPal, Apple Pay, Google Pay).

6. Shipping

Shipping terms, including free shipping on retail orders of $50 or more, processing and delivery estimates, and the ground-only rule for chemicals, are in our Shipping policy (www.polariscarcare.com/pages/shipping-returns). Delivery dates are estimates only. Risk of loss passes to you when the carrier delivers to the address you gave us.

7. Returns and refunds

Returns and refunds are governed by our Returns & Refunds policy (www.polariscarcare.com/pages/refund-policy): returns are accepted only for defective products, including items that arrive damaged or incorrect, reported within 30 days of delivery (90 days for manufacturing defects in tools and equipment). Email us first. All other sales are final.

8. Retail and wholesale

The retail store is for personal use. Businesses that want to buy for resale or professional use can apply to our Pro Detailer wholesale program (www.polariscarcare.com/pages/wholesale), which has its own pricing, shipping rates and terms.

9. Intellectual property

The Polaris Car Care name, logo, photos, videos, text and designs on the Site belong to Polaris Car Care LLC or our licensors. You may not copy or use them commercially without our written permission.

10. Reviews and content you send us

If you send us a review, photo, suggestion or other content, you give us a non-exclusive, royalty-free, worldwide licence to use it to operate and promote our business. You confirm it is yours, truthful, and that you disclosed any free product or payment you received in connection with it.

11. Acceptable use

You agree not to use the Site for anything unlawful, to interfere with its operation, to scrape it, to place fraudulent orders, or to misuse discount codes.

12. Disclaimer of warranties

Products are supplied "as is" except as expressly stated in their descriptions. To the fullest extent permitted by law we disclaim implied warranties, including merchantability and fitness for a particular purpose. Always follow the care and label instructions; we are not responsible for damage caused by misuse, such as drying a dirty vehicle, washing the towel with fabric softener, or using a chemical product against its label directions.

13. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to the Site or a product is limited to the amount you paid for that product, and we are not liable for indirect, incidental or consequential damages. Some states do not allow these limits, so they may not apply to you.

14. Indemnity

You agree to indemnify Polaris Car Care LLC against claims arising from your breach of these Terms or your misuse of the Site.

15. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.

16. Changes

We may update these Terms by posting a new version on the Site. The date at the top shows the latest revision. Your continued use of the Site after a change means you accept it.
